This statutory and case supplement incorporates the newly restyled Federal Rules of Evidence and the newly amended Rule 803(10), along with the relevant Advisory Committeeâ€™s Notes. A side-by-side reprinting of the unrestyled and restyled rules allows for ready comparison. Editorâ€™s notes point out those areas where the restyling project, contrary to its authorsâ€™ claimed intentions, worked substantive changes in the rules. A case supplement analyzes the Supreme Courtâ€™s recent grant of certiorari in Warger v. Shauers, which will be argued in October 2014, as well as the Court's ruling in Salinas v. Texas, 133 S. Ct. 2174 (2013). Warger v. Shauers raises questions in the application of rule 606(b). Salinas v. Texas addresses the prosecutionâ€™s use in its case-in-chief of a suspectâ€™s silence in response to noncustodial police questioning.
